• J <br /> #08-3344 Big Island Dock System <br /> February 13,2008 <br /> Page 6 <br /> Wetland Impacts <br /> The proposed activity is in an area that drains directly to the lake, hence the criteria for <br /> triggering the establishment of wetland buffers is not met. However, a11 wetlands on the <br /> site are currently protected under a conservation easement that establishes the MCWDs <br /> right to manage the wetlands in an appropriate manner, and that prohibits a variety of <br /> activities or actions that would have negative impacts on the wetlands or their natural <br /> buffers. <br /> Staff Recommendation <br /> Staff recommends approval of the requested variances subject to the following . <br /> conditions: <br /> 1. Prior to Council action, provision of detailed survey work including one-foot <br /> contours for the area of the proposed construction, and placement of the pads and <br /> sidewalks on that survey, to confirm whether there will be any filling of the <br /> floodway or flood fringe areas. � � <br /> 2. If there will be floodway or flood fringe impacts, provision of a mitigation plan <br /> meeting MCWD and other agency requirements. <br /> 3. Establishment of runoff quality management measures such as vegetated swales <br /> or rain gardens as part of the construction plan. <br /> 4. Adherence to applicable ADA design requirements. <br /> 5. A land alteration permit must be obtained from the City before commencing <br /> construction. The appropriate permits from other agencies (MCWD, LMCD) � <br /> shall be obtained before commencing construction. <br /> 6. Hardcover within 75' of the shoreline shall be limited to the 1400 s.f. approved <br /> via this variance process. <br />
