The property in question cannot be put to a reasonable use if used under <br /> � conditions allowed by the official controls <br /> Due to the narrow lot width, compliance with the required side setbacks would result <br /> in a garage depth of only 19 feet which is not deep enough to store a vehicle. While a <br /> setback variance is being requested,the proposed plan greatly reduces the <br /> encroachment that currently exists. The current detached gazage is located on the lot <br /> line,with the overhang encroaching over the lot line. <br /> 2. The plight of the landowner is due to circumstances unique to his property not <br /> created by the landowner.` � ' � <br /> This neighborhood was subdivided many years ago,prior to tlie current ordinances. <br /> 3. The variance, if granted,will not alter the essential character of the locality. <br /> The remodeled home and attached garage will be consistent in size and appearance to � <br /> others that have been recently remodeled along Shadywood Road. <br /> ,�,�.::,��:._ _ <br /> 4. The special conditions applying to the structure or land in question are peculiar� � <br /> to such property or immediately �djoining property. <br />� T'he lots along this portion of Shadywood Road are generally 50 feet in width,which <br /> is smaller than required by ordinance. This lot is even smaller and narrower due to the <br /> presence of the road easements on two sides of the property. The adjacent road right of <br /> � - � way is extra wide (66 feet rather than 60). The ciry has confi.rmed that it is unlikely the <br /> road will be widened from its current 20-22 foot width which results in a large buffer <br /> zone between the road and the property. <br /> 9. The conditions do not generally apply to other land of structures in the district <br /> The presence of the road easements is unique to this property and those directly across <br /> the road. <br /> 10. The granting of the application is necessary for the preservation and enjoyment <br /> of a substantial property right of the applicant. <br /> Allowing the garage to be attached will greatly increase the usability and enjoyment of <br /> the property while it also improves the safety along the road by removing the detached <br /> garage. The small deck that is requested will be on the road side of the home, and not <br /> seen by the neighbors which will enhance the properry rights of the neighboring as well <br /> . : _.as the owner. This proposal will also move hazdcover further from the lake, although still <br /> in the 0-75 foot zone. <br /> 11. The granting of the proposed variance will not in any way impair health,safety, <br /> comfort,morals or in any other respect be contrary to the intent of the Zoning <br /> Code. <br /> The granting of these variances will improve safety. <br />
