"The special conditions applying to the structure or land in question are peculiar to such <br /> property or immediately adjoining property." The existing home on the Property has been <br /> remodeled through the years, yet predates the current zoning regulations regarding <br /> setbacks, etc. and most of the homes on adjacent properties. This is unique to the <br /> Property. <br /> 9. "The conditions do not apply generally to other land or structures in the district in which the <br /> land is located." The home and stone patio are situated right up to the lake. The <br /> neighboring home to the west is situated at a similar setback to the lake and in a similar <br /> orientation; the home on the property to the east is over 120 feet from the subject home <br /> and is oriented toward the lake in the opposite direction. The proposal does not appear to <br /> be out of character with the area. <br /> 10. "The granting of the application is necessary for the preservation and enjoyment of a <br /> substantial property right of the applicant."This statement is true; this criterion is met. <br /> 11. "The granting of the proposed variance will not in any way impair health, safety, comfort or <br /> morals,or in any other respect be contrary to the intent of this chapter."The proposed garage <br /> addition will not impair the health, safety, comfort or morals of the public. <br /> 12. "The granting of such variance will not merely serve as a convenience to the applicant, but <br /> is necessary to alleviate demonstrable difficulty."There is no other feasible way to add <br /> additional space on to the existing garage as the house is angled toward the property <br /> line. This criterion is met. <br /> CONCLUSIONS. ORDER AND CONDITIONS: <br /> Based upon the above findings, the Orono City Council hereby grants the following: <br /> • A variance from Orono Municipal Code Section 78-305 to permit construction of a garage <br /> addition encroaching as close as 10.2 feet to the side lot line where a 30-foot setback is <br /> normally required; and <br /> • A variance to Orono Municipal Zoning Code Section 78-1279 to allow construction of <br /> a garage addition 71 feet from the OHWL where a 75-foot setback is normally required; <br /> and <br /> • Variances to Orono Municipal Zoning Code Sections 78-1680 and 78-1700 to permit <br /> 34.6% total hardcover where 34.7% currently exists; and 14.8% hardcover within the <br /> 0-75-foot zone where 16.6% currently exists, in conjunction with construction of a <br /> garage addition and reconstruction of the driveway, subject to the following conditions: <br /> 1. Council approval is based on the survey by Gronberg and Associates dated 06/20/16 and <br /> building plans submitted by the Applicant and annotated by City staff (hereinafter the <br /> 4 <br />
