Gaffron stated no one from the City caught the fact that it was filed as a public road rather than a private road outlot. The mayor later signed an agreement correcting the situation but that the City does not have a signed copy by the developer. Gaffron commented it would be difficult to locate this developer. Murphy inquired whether these fees were originally paid and whether these fees have been paid twice. Gaffron stated an argument could be made that the developer paid to subdivide the land in a certain mamzer, which never happened, and that now these applicants are paying fees to accomplish the same thing that was never followed through with by that developer. Murphy stated he would be in favor of waiving the fees if the City already collected some fees for the original platting. Morrison commented Mr. Sticlaiey had pointed'out that the road cannot be both a public and a private road and that they have had to incur thousands of dollars to make it a private road.
