Murphy moved, Sansevere seconded, to adopt RESOLUTION NO. 5476, a Resolution Granting a <br />Variance to the Average Lakeshore Setback for the property located at 3320 Fox Street. <br />VOTE: Ayes 4, Nays 0. 1 <br />8. #06 -3200 HICKORY FINE HOMES, 1374 REST POINT ROAD — VARIANCE <br />Steve Bohl, Developer, and Gary Gangstee, Applicant, were present. <br />Gaffron stated the applicant is requesting a number of variances to rebuild on a property located on Rest <br />Point Road. The lot consists of .65 acre where 1.0 acre is required. The applicant's initial request was <br />for 8.1 percent of hardcover in the 0 -75' zone and to retain nonconforming accessory structures in the 0- <br />75' zone and lakeward of the average setback. In addition, the applicants have requested hardcover of <br />32.9 percent in the 75 -250' zone. <br />Gaffron indicated the applicants have since provided a revised plan that reduces the proposed house <br />footprint slightly and reduces the patios around the pool. The proposed 0 -75' hardcover is reduced to <br />6.77 percent, excluding the necessary wood steps to the lake. The proposed 75 -250' hardcover is <br />reduced to 29.77 percent, but still proposes to retain ! he nonconforming accessory structures. <br />The Planning Commission held a public hearing on May 15, after which the Planning Commission <br />suggested the applicant remove the nonconformities land get the 75 -250' zone down to 25 percent as has <br />commonly been required for lakeshore rebuilds on lots this size. The Planning Commission initially <br />tabled the application and then at the request of the applicant voted 5 -0 to recommend denial and <br />• forward the application to the Council. <br />PAGE 11 of 11 <br />
