Brokl stated the materials submitted by the neighbor do not directly relate to the <br />nonconformities and/or the conditional use permit that is being requested and are general objections to the <br />changes that are occurring on this property. <br />Murphy stated he would like to be sensitive to the neighbor's concerns, but that he fails to see the impact <br />to the neighbor if this application were approved. Murphy pointed out the structure and deck would not <br />be visible from the adjoining property and that the letter appears to reflect other issues that have gone on <br />between the two neighbors. <br />Sansevere stated in his opinion the Council needs to address, perhaps in a work session, the allegations <br />made by Mr. Floyd concerning City Staff. Sansevere commented he hopes those comments have not <br />been made frivolously by Mr. Floyd. <br />Mr. Floyd stated those comments are not frivolous. <br />Sansevere stated he would take exception to the allegations made by Mr. Floyd, but that tonight's meeting <br />is not the place to discuss them. <br />Murphy stated he is happy to know that the City Attorney and City Staff are dealing with some of the • <br />issues raised by Mr. Floyd but that he does not want this application to get caught up in the other <br />unrelated items. <br />Sansevere stated in his view the neighbor's letter goes beyond the application by the Brooks. <br />Brokl concurred that the letter does contain a number of items that are not related to the application by the <br />Brooks and that tonight's meeting is not the means by which those items will be resolved. Brokl stated <br />the City would be looking at those items in the future. <br />Brooks pointed out the improvements are not visible to the Floyds. <br />McMillan stated she does see a hardship given the fact that the property is on a peninsula and that there is <br />very little buildable area. McMillan concurred that there should be restrictions placed on the conditional <br />use permit, but that she feels an attractive structure along the lakeshore would be an asset to the property. <br />Robert Floyd, 960 West Ferndale Road, requested he be allowed to speak on this application. <br />White requested Mr. Floyd limit his comments to the issues relating to tonight's application. <br />Mr. Brooks excused himself from the meeting. <br />Floyd stated as far as the relevancy of what is contained in his letter, he feels that the items raised in the <br />letter do relate directly to tonight's application. Floyd stated in order for the proposed work to be <br />accomplished, access would need to be obtained. <br />PAGE 14 of 25 <br />
