RESOLUTION OF THE CITY COUNCIL <br /> L`9�kEggOg'� NO. � � � � <br /> A RESOLUTION GRAI�'TING CERTAIN VARIANCES <br /> TO MUI�'ICIPAL ZONING CODE <br /> SECTION 10.22, SUBDIVISION 2; AND <br /> SECTION 10.56, SUBDIVISION 16 (L)(2) <br /> FILE NO. 03-2898 <br /> WHEREAS, Julie and Mike Whittington, husband and wife, (hereinafter "the <br /> applicants"j are the ow�ners of the property located at 1981 Fagerness Point Road,within the City of <br /> Orono (hereinafter "the City") and legally described as follows: <br /> Lot 4,Fagerness,and accretions thereto lying beriveen the extension southeasterly to <br /> the shore of Lake Minnetonka of the Northeasterly and Southwesterly lines of said <br /> Lot 4, Hennepin County, Minnesota(hereinafter "the property"); and <br /> �VHEREAS, the applicants have applied to the City for variances from Municipal Zoning <br /> Code Section 10.22, Subdivision 2; and Section I0.56, Subdivision 16(L)(2)to permit construction <br /> of a deck and stairs 5' in height onto the existing home, requiring S,Sy6 s.f. (41.56%) hardcover <br /> �.vithin the 75' to 250' setback zone �vhere 3,366 s.f. (2�%) is permitted, and <br /> WHEREAS, after due published notice and mailed notice in accordance with <br /> Minnesota Statutes and the City of Orono Zoning and Planning Codes, the Orono Planning <br /> Com.mission held a public hearinj on May 19, 2003, at�vhich time all persons desiring to be heard <br /> concernir.g this application were given the opportunity to speak thereon. <br /> NO�V, THEREFORE, BE IT RESOLVED by the City Council of Orono, <br /> Mirzn��sota: <br /> FINDINGS <br /> l. This application was reviewed as Zonina File �03-2898. <br /> 2. The property is located in the LR-1C Zoning District, where 0.5 acres is the <br /> minimum required lot area. The property consists of approximately 0.68 acres. <br /> 3. The Orono Planning Commission reviewed this application on May 19, 2003 <br /> and recommended approval by a vote of 5 to 0. <br /> Page 1 of 5 <br />
