VOTE: Ayes 4, Nays <br />7. #05 -3078 GARY AND LYNN <br />I <br />ir horses outside during Minnesota winters even <br />due to their respiratory conditions. <br />#05 -3077, Barry and Robin O'Rourke, <br />,3560 IVY PLACE — VARIANCE <br />Gary Christensen, Applicant, was present. <br />1 <br />Curtis stated the applicants are requesting variances in order to replace their existing low- pitched roof <br />with a steeper roof resulting in a half -story to include attic storage space. The existing home is set back <br />40 feet from the lake and 8.25 feet from the side lot line. <br />The applicants are requesting the following variances : <br />1. A lake setback variance to increase the height of the roof at a setback of 40 feet from the OHWL <br />where 75 feet is required; and <br />2. A side setback variance for a setback to increase the height of the roof at a setback of 8.25 feet <br />from the side lot line where 10 feet is required; and <br />3. An average lake setback variance. ;I <br />Curtis noted the applicants also have a variety of structures and non - structural encroachments located on <br />the adjacent property not owned by them, which Staff and the Planning Commission are recommending <br />be removed. <br />At their February meeting the Planning Commissiori voted 4 to 1 to recommend approval of the variances <br />subject to the following conditions: <br />1. Removal of all encroachments that cross over the property line or exist on the neighboring <br />property; and l <br />2.
