a <br />MINUTES OF THE <br />ORONO CITY COUNCIL MEETING <br />Monday, January 24, 2005 <br />7:00 o'clock p.m. • <br />ZONING ADMINISTRATOR'S REPORT <br />3. #04 -3016 - WAYZATA DESIGN AND DEVELOPMENT, 120 BROWN ROAD SOUTH, <br />FINAL SUBDIVISION APPROVAL — RESOLUTION NO. 5279 <br />Representative Henry Lazniarz was present. <br />Gaffron explained that the City Council had reviewed various aspects of the final plat application at a <br />previous meeting, including concerns voiced by neighboring property owners. The applicant has since <br />revised plans responding to the comments by the City Engineer and the discussions among the Council <br />and neighbors. Gaffron indicated that staff has reviewed the various legal documents with the applicant's <br />attorney and is continuing to make minor revisions, to that end, staff would recommend approval of the <br />Final Plat Approval Resolution, subject to satisfactory completion of all required submittals, plans, <br />documents, payments, etc. prior to release of the plat and associated documents for filing. <br />With regard to the Engineering Plans, Gaffron stated that the revisions were minor and could be worked <br />out, if the City Council is comfortable with approving the plat subject to staff and City Engineer approval. <br />In addition, staff has been advised by the applicant that the MCWD permits would be issued shortly. <br />Although the applicant had proposed the road name to be `Creekside Trail', Gaffron explained that the <br />police department has rejected this name, or any other name with `creekside' in it to avoid confusion with <br />similarly named streets in Orono and Long Lake. Gaffron pointed out that `creek- something' would likely <br />be decided upon at a later date. <br />• <br />Gaffron reiterated that staff recommended adoption of the resolution for Final Plat Approval of <br />CREEKSIDE IN ORONO, subject to satisfactory completion of all required submittals, plans, <br />documents, payments, etc. prior to release of the plat and associated documents for filing. Staff would <br />also recommend that the Council authorize the Mayor, clerk and City staff to execute the Developers <br />Agreement once it has been approved by the City Attorney and Planning Director. <br />McMillan asked if staff was satisfied with the proposed conservation easement language. <br />Gaffron stated that, once the language had been tweaked, staff was satisfied. <br />Lazniarz made a minor correction on page 4 of the Resolution under the Lot 2 heading to reflect Lot 2. <br />Sansevere moved, Mayor Peterson seconded, adopting RESOLUTION NO. 5279, a Resolution <br />which grants Final Plat Approval of CREEKSIDE IN ORONO, subject to satisfactory completion <br />of all required submittals, plans, documents, payments, etc. prior to release of the plat and <br />associated documents for filing, and authorizes the Mayor, clerk and City staff to execute the <br />Developers Agreement once it has been approved by the City Attorney and Planning Director for <br />120 Brown Road South. VOTE: Ayes 3, Nays 1, Murphy dissenting. <br />Murphy commented that his concerns still exist that they are trying to `shoehorn' more into the space than <br />should be allowed. Although he recognized Lazniarz for working closely with the City and neighbors to <br />be within the codes and satisfy concerns, Murphy still felt the development was too much. <br />U <br />PAGE 2 of 6 <br />
