Monday,March 19,2007 � • <br /> 6:00 o'clock p.m. <br /> (#06-3246 Highmark Builders, Continued) <br /> Morris stated he is agreeable to working with the City Engineer to resolve any drainage problems. <br /> Morris noted the property slopes rather drastically towards Mr.Titler's property and that the relocation <br /> of the driveway would help to reduce the runoff onto Mr.Titler's property. <br /> Kempf stated in order to resolve the drainage issues,there will need to be some cooperation between the � <br /> neighbors and that the Planning Commission would defer to the City Engineer on the grading and <br /> drainage issues. <br /> Kempf noted there is a very slight intrusion being proposed into the average lakeshore setback under <br /> this plan,which is a better option than relocating the house either in front or in back of the utility <br /> easement. <br /> Kempf inquired whether there is the need for a turn-around. <br /> Turner stated she would defer to the City Engineer on that item. <br /> Winer moved,Kang seconded,to recommend approval of Application#06-3246,Highmark � <br /> Builders on behalf of the Estate of Mary Jo Peterson,4205 North Shore Drive, granting of lot area� • <br /> and lot width variances,a hardcover variance, and an average lakeshore setback variance,subject � <br /> to approval of the grading and drainage plan by the City Engineer and also subject to the location <br /> of the average lakeshore setback line being determined by a field survey and the encroachments <br /> being shown on a survey before this application is considered by the City Council. <br /> VOTE: Ayes 5,Nays 2,Kroeger and Zullo opposed. <br /> Kroeger stated in his opinion the applicant does have other options to meet the average lakeshore <br /> setback requirement. <br /> Zullo stated in her opinion the garage could be relocated away from the house. <br /> 4. 06-3249 CITY OF ORONO,OUTLOT A, STONEBAY, COMPREHENSIVE PLAN <br /> AMENDMENT,6:48—7:42 P.M. � <br /> Gaffron stated the City of Orono is proposing an amendment of the Orono Community Management <br /> Plan to"undo"the prior amendment adopted in 2004 that under strict conditions allowed an expansion <br /> of retail opportunities within Outlot A, Stonebay. Associated with the amendment would be rezoning of <br /> the site from RR-1B Single Family Rural Residential to B-6 PUD Highway Commercial District. This <br /> rezoning was not included in the legal notices but would follow any reguiding of the site. <br /> This item was last reviewed at the January Planning Commission meeting. At that time the property • <br /> owners' representative, Steve Johnston,requested a six-month tabling of the comp plan amendment and <br /> rezoning to allow time for submittal of an application for a bank and food co-op for the site.
