MINUTES OF THE <br /> ORONO PLANNING COMMISSION MEETING <br /> Monday,March 19,2007 • <br /> 6:00 o'clock p.m. <br /> OLD BUSINESS . <br /> 3. 06-3246 HIGHMARK BUILDERS ON BEHALF OF THE ESTATE OF MARY JO <br /> PETERSON,4205 NORTH SHORE DRIVE,VARIANCE,6:04—6:48 P.M. <br /> Jim Morris,Highmark Builders,was present. <br /> Turner stated the applicant is requesting the following variances to allow construction of a replacement <br /> resident: <br /> 1. Lot area variance of 0.62 acre when 1 A acre is required; <br /> 2. Lot width variance of 60 feet when 140 feet is required; <br /> 3. 29.9 percent hardcover in the 75 to 250 foot zone when 25 percent is allowed; <br /> 4. An average lakeshore setback to pernut encroachment into this setback by part of the deck stairs <br /> and approximately five square feet of the house. <br /> Turner noted the average lakeshore setback line was established off of the building permit plans for the • <br /> adjacent house and would need to be�e.ld verified. <br /> The Commission considered this request in November 2006. At the request of Staff and the applicant,it <br /> was tabled to allow the house and site plan to be redesigned to eliminate the three-story design,reduce <br /> the amount of hardcover, and eliminate the average lakeshore setback variance. The revised proposal is <br /> for house with two stories plus a basement. The revised plan reduces the hardcover down to 29.9 <br /> percent,with the excess amount being the amount that is required to extend the driveway through the <br /> easement. Turner noted there is a sewer line that runs through the properly. It is Staff's feeling that had <br /> that sewer line not existed,the applicants would have been able to relocate the house forward,which <br /> would put all the driveway into the 250-500 foot zone and result in the house meeting the City's <br /> hardcover requirements. <br /> The City routinely reviews lot width and lot area requests and grants them when no other land is <br /> available for acquisition and the property existed in separate ownership from adjacent properties prior to <br /> adoption of the current zoning standards. This lot satisfies those requirements. Similar variances were <br /> granted for the property to the west. <br /> Planning Staff recommends approval with the following conditions: <br /> 1. Approval of the lot area a�id width variance subject to approval of the grading plan by the City <br /> Engineer. <br /> 2. Approval of the hardcover variance to allow 29.9 percent hardcover in the 75-250 foot zone. • <br /> PAGE 2 <br />
