. , <br /> NIINUTES OF THE <br /> ORONO PLANIVING COMMISSION MEETING <br /> Monday,March 19, 2007 • <br /> 6:00 o'clock p.m. <br /> (#07-3276 Robert Luesse,Continued) <br /> Kempf inquired how old the stairway is. <br /> Luesse stated the stairway was constructed after the house was built and is at least 35 years old. <br /> Kempf commented the stairway appears to be gettirig to the point where it should be replaced. <br /> Luesse inquired whether Commissioner Zullo's comments related to the stairway or the deck. <br /> Curtis noted a stairway is allowed down to the lake along with a landing of 12 square feet in the 0-75 <br /> foot zone. <br /> Zullo stated she does not see the need to remove the decking at this point in time. <br /> Kroeger inquired whether the average lakeshore setback would be calculated from the outer point of the <br /> deck rather than the corner of the house. <br /> Gaffron stated in this situation,if this is a grade level deck or no higher than six feet above grade, it • <br /> would be measured from the house. Gaffron stated he is unsure what the topography in the area is. <br /> Luesse stated the deck extends approximately eight or nine feet out. � <br /> Gaffron stated that would change the average lakeshore setback line. <br /> Kempf stated the deck and stairs appear to be getting due for replacement. Within the 0-75 foot zone <br /> there is a large deck and that the portion of the stairway that accesses the other set of stairs is five feet <br /> wide and then there is a third deck. Kempf stated the uppermost deck is very close to the grade of the <br /> front yard and that that deck should be removed out of the 0-75 foot zone. Kempf stated it is his <br /> impression that the stauway and landings are out of compliance and should be replaced in some fashion. <br /> Gaffron stated the decks are nonconforming and can be replaced in kind but not expanded. <br /> Rice commented the applicant is able to replace the house in its current location and asked if the second <br /> story fits within the setback. <br /> Curtis stated the applicant would like the second floor to be on the same exterior wall as the�rst floor to <br /> allow for a three bedroom con�guration on the top level. <br /> Kempf inquired whether the cap would be removed and then the house rebuilt from that. <br /> Luesse stated it would be. � • <br /> Kempf noted the engineer's report states it is impossible to fill the block foundation and that there is a <br /> long horizontal crack in the wall,which suggests�failure of the foundation.
