MINUTES OF THE <br /> ORONO PLANNING COMMISSION MEETING <br /> Monday,November 17,2008 <br /> 6:00 o'clock p.m. <br /> (08-3388 BOYER BUILDERS ON BEHALF OF MATTHEW AND AMY HERMAN,CONT.) <br /> Kempf noted the majority of the driveway is located within the wetland setback. <br /> Curtis stated the setback from the edge of the buffer is a structural setback. Curtis indicated the location <br /> of the driveway is an acceptable encroachment in the wetland buffer setback. The goal with the 20-foot <br /> setback from the edge of the wetland buffer is to allow for yard space between what would be the wetland <br /> buffer and the edge of the home. <br /> Turner stated the brown areas on the survey are the encroachments. <br /> Kempf asked how buffer averaging would work and how that area would change. <br /> Turner stated the square footage of the buffer would be the same but would be located in a different area. <br /> Turner indicated the buffer could be 20 feet in one area and 65 feet in another. <br /> Bennett noted the proposed addition would be shifted closer to Cherry Avenue,which would push it into <br /> the buffer zone. <br /> Turner stated the addition is akeady located in the buffer zone but that they are changing the positioning <br /> of the structure slightly within the buffer zone,which would reduce the hardcover slightly. Turner stated <br /> there is currently a two-foot offset between the 24-foot wide section of the garage and the 12-foot wide <br /> section of the garage,which could probably be increased to four feet. <br /> Carl Smith,Boyer Building,noted they have been working on these plans for a number of months and <br /> that they were initially unaware of the wetland buffer.A survey was completed,which depicted a wetland <br /> on the west side of the property as well as the east side,which further complicated their plans. They did <br /> meet with Planner Turner to deternune a location that would have the least amount of impact to the <br /> setbacks but were also informed that the location of the wetland on the east side of the property <br /> constitutes a lake setback,which resulted in the property being shifted to a different zone that allowed less <br /> hardcover. <br /> Smith noted the existing house exceeds the hardcover by one percent and that they have attempted to <br /> minimize the hardcover on the lot as much as possible. Smith pointed out the location of the swale. <br /> Smith stated this was a difficult lot to work with but that they feel the proposed plan is the best plan they <br /> could come up with. <br /> Winer stated there are varying elevations listed on the survey and that the elevations range from 9313 by <br /> . the building setback line to 931.8 to 933.7. Winer asked whether the elevations are correct. <br /> Smith stated the topography goes up and then comes back down again,with a crest in the property. <br /> Winer asked whether there are any issues with drainage. <br /> Smith illustrated the flow of the drainage and noted that the floor of the garage will be raised by 1.5 feet, <br /> which will enhance the drainage. <br /> Winer asked whether that would direct more runoff into the wetlands. <br /> PAGE 7 <br />
