' � <br /> ��- �-� Clt� o� ORONO <br /> ,:: . <br /> • ,,�;, �� � RESOLUTION OF THE CITY COUNCIL <br /> � � NO. 2720 <br /> .( • � • • <br /> . . <br /> A RESOLIITION GI2ANTING <br /> A VARIANCE TO <br /> MONICIPAL ZONING CODE . <br /> SECTION 10.27, SDBDIVISION 5 (B) <br /> FII,$ #1462 <br /> WHER$AS, Richard Schmidt (hereinafter "the applicant") <br /> is the owner of the property located at 3980 Watertown Road <br /> within the City of Orono (hereinafter "City") and legally <br /> described as follows: <br /> Exhibit A attached (hereinafter "the property"); and <br /> WHEREAS, the applicant has applied to the City for a <br /> variance to Municipal Zoning Code Section 10.27, Subdivision 5 <br /> • (B) to permit the construction of a second story addition to the <br /> existing residence which is located 35' from the front lot line <br /> where a front yard setback of 100' is normalZy required. . <br /> NOW, THEREFORE, BE IT RESOLV$D by the City Council of <br /> Orono, Minnesota: <br /> FINDINGS <br /> l. This application was reviewed as Zoning File #1462. <br /> 2. The property is located in the RR-lA Single Family Rural <br /> Residential Zoning Distri:ct. <br /> 3. The Orono Planning Commission reviewed this application <br /> on October 16 , 1989 , and recommended approval of the <br /> proposed variance based upon the following findings: <br /> A) The existing residence was constructed in 1954 and <br /> met setback requirements in ef f ect at that time. The <br /> property was rezoned from a 1 acre status to a 5 acre <br /> minimum lot size in 1975, requiring a 100' front yard <br /> setback for any new construction occuring after 1/1/75. <br /> B) The proposed second story addition will encroach no <br /> • closer to the front lot line than the existing <br /> residence, which is 35' from the front lot line. <br /> • Page 1 of 4 <br />
