Ey�rY '� �� S��ey�3 �� y��+ CONCLDSIONS, ORD$R AND CONDITIONS E��'`�� Based upon one or more of the above findings, the Orono �°� City Council hereby grants variances to Municipal Zoning Code Section 10.28, Subdivision 5 (B) and Section 10.75, Subdivision • 4 (B) , and grants a conditional use permit per Sectiori 10.03, Subdivision 10, to allow the installation of a pool on a through � lot to be placed 24'9" from the rear street lot line instead of 50' and a rear addition to the principal structure that will be located 19' from the north side Zot line instead of 30', subject to the following conditions: l. Per Section 10.03, Subdivision 4 (C) the applicant and/or future owner is placecl on notice that if a fence of 6' or • greater is installed around the pool, such improvement would require variance approval from the City of Orono. 2. Authorities granted by this resolution run with the property not with the applicant, but are permissive only and • must be exercised by application for a building permit for the retaining walls within one year of the date of Council approval, or the special conditions of this resolution will expire on that date (September 25, 1990). 3. Violation of� or non-compliance with any of the terms and conditions of this resolution shal 1 constitute a violation of the zoning code, shall automatically terminate any authority granted herein, and shal 1 be punishable as a misdemeanor. 4. The undersigned applicant has read, understood and hereby agrees to the terms of this resolution and on behalf of himself, his heirs, successors and assigns, hereby agrees to the recording of this resolution in the chain of title of the property.
