VOTE: Ayes 5, Nays 0. <br />12. #07 -3255 CATHERINE SWEET, 3405 CRYSTAL BAY-ROAD — VARIANCE <br />Mike Doyle, CHS Construction, appeared on behalf of the Applicant. <br />Turner stated the applicant is requesting a setback variance to construct a replacement garage with a <br />two -foot setback from the westerly side propertyline when a 15 -foot setback is re(fuired. A hardcover <br />• variance is also requested. An encroachment permit is also required for a portion of the driveway that is <br />within an unimproved street right -of -way. j <br />Turner stated the applicant's property is adjacent to a 20 -foot wide unimproved street right -of -way. The <br />right -of -way extends from the Hennepin County Rail Authority right -of -way to the lake. It seems to <br />have been intended to provide lake access for the lots on Bayview Place to the south. This street right - <br />of -way has been identified as a possible locationlfor a trail linking the Dakota Trail and the city property <br />along the lakeshore. The trail would be eight feet wide. The City Attorney has advised that the trail be <br />separate from the driveway for liability reasons.' Placing the trail and the driveway within the right -of- <br />way would require removal of a large blue spruce, a large pine tree, and a large shrub that appear to <br />belong to the property on the other side of the right -of -way. <br />The property has a single -stall garage under the front porch that is entered from the side. Until recently <br />it also had a small single -stall detached garage located to the rear of the house, Turner stated the <br />applicant had provided a revised site plan but the' driveway would probably need to be straightened out <br />to allow for easier access. <br />Doyle stated if the garage were relocated closer fo the easement, it would be easier to locate the <br />driveway.
