By way oi' realtor inquiry each time a <br /> property within the subdivision of t�laplegate Inlet is for sale, the <br /> City has become aware that at some time in the past, easements may <br /> have been created which purport to grant boat docking rights to off- <br /> lake property owners in the Maplegate Inlet Subd�_vision . <br /> While the City is not in a position at the moment to conclude whether <br /> such easements are legitimate or legal, it is clear that this use has <br /> continued for many years without the required Joint Use Dock license. <br /> The requirement for a Joint Use Dock licen�e has bePn in effect since <br /> 1963 . A copy of the current orclinance is attached for your review. <br /> �ccording to City records, you purchased the subject property either <br /> directly from Eberhardt Company or as a tax forfeit parcel , in 1981. <br /> Sn 1978 , Eberhardt Company had been advised of the need for the <br /> license, but never followed through. <br /> Our £iles also indicate informal discussions between you and Building <br /> Inspector Tom Jacobs in 1986, referencing illegal boats being docked <br /> on the property. There is no clear indication in our file that you <br /> have previous ly been forma 1 ly advised of the need for a Joint Use Dock <br /> license. <br /> The license application form has been enclosed for your use. Please <br /> submit the complet.ed appl.ication and appropriate fee as soon as <br /> possible.
