MINUTES OF THE <br />ORONO CITY COUNCIL MEETING <br />Monday, July 14, 2008 <br />7:00 o'clock a.m. <br />*7. #08 -3366 JESSICA BROWN/PHIL LUSARDI, 45 MYRTLEWOOD ROAD — VARIANCE <br />— RESOLUTION NO. 5758 <br />Murphy moved, Bremer seconded, to adopt RESOLUTION NO. 5758, a Resolution Granting a <br />Variance to Municipal Zoning Code Section 78 -420, for the property located at 45 Myrtlewood <br />Road. VOTE: Ayes 5, Nays 0. <br />8. #08 -3368 CITY OF ORONO, NAVARRE — REZONING — ORDINANCE NO. 46, THIRD <br />SERIES <br />Peter Johnson, Attorney -at -Law, was present on behalf of Bank of the Lakes. <br />Murphy stated he did not put this on the Consent Agenda because he was unsure what exactly the bank <br />was requesting. Murphy commented the Planning Commission minutes do not shed light on the bank <br />issue. <br />• <br />Johnson stated the bank would prefer not to be involved in the rezoning for the parcel they own and <br />would prefer to maintain the status quo. Johnson noted one of the city's ordinances states if you have <br />split zoning on a parcel, you are allowed to use the zoning for 50 feet on either side of the line. -In this <br />particular case, the parcel is 93 feet wide and a line down the middle. Johnson stated both of the current <br />zoning classifications essentially would cover almost the entire parcel if there was a plan to develop the <br />land, which the bank currently does not have any plans to develop the property. Johnson requested the • <br />bank located at 2445 Shadywood Road not be included in the rezoning. <br />White asked what the impact would be if that property is not included. <br />Rahn noted the ordinance is designed to clean up the zoning in this area. <br />Murphy moved, Bremer seconded, to adopt Exhibit B, ORDINANCE NO. 46, Third Series, An <br />Ordinance Amending the Municipal Code of Orono and Amending the Official Zoning Map by <br />Rezoning Portions of Properties Within the Block Bounded by Shadywood Road, Shoreline Drive, <br />Kelly Avenue and Lydiard Avenue. VOTE: Ayes 5, Nays 0. <br />*9. #08 -3369 LUCI CHORLEY,1860 AND 1880 FOX STREET — FINAL PLAT — <br />RESOLUTION NO. 5659 <br />Murphy moved, Bremer seconded, to adopt RESOLUTION NO. 5659, a Resolution Approving the <br />Plat of Waldron Woods. VOTE: Ayes 5, Nays 0. <br />10. CITY OF ORONO CODE AMENDMENT — REVISION OF CHAPTER 86 RELATING <br />TO BUILDING PERMIT SURVEYS <br />Murphy asked what the impact to the homeowners would be if this ordinance is passed. Murphy <br />indicated a number of residents have commented that they are having to incur the costs for a number of <br />surveys and that they feel it is becoming excessive. • <br />PAGE 6 of 11 <br />
