It would include re-vegetating the slope, installing approximately 40 <br /> lineal feet of retaining wall, replacing the steps to the lake, adding a lakeside patio and a <br /> deck over the slope. The Applicant requests a conditional use permit for a retaining wall <br /> within the 75' lakeshore setback, a hardcover variance for the retaining walls, patio and <br /> decks within the 0' to 75'zone, a lakeshore setback variance for the deck, and a variance <br /> to permit intensive vegeta.tion removal within the 0' to 75' foot zone preparatory to <br /> re lanting the slo e. <br /> Staff Recommendation: Planning Department Staff recommends approval of the <br /> vegeta.tion removal variance but does not recommend approval of the hardcover and <br /> setback variances and the conditional use ermit. <br /> Pertinent Zoning Ordinance Sections <br /> Sec. 78-1211. [Shoreland] Definitions. <br /> Intensive vegetation clearing means the complete removal of trees or shrubs in a <br /> contiguous patch, strip,row or block. <br /> Sec. 78-1283. Steep slopes. <br /> Any applicant requesting a permit for construction of sewage treatment systems, <br /> roads, driveways, structures or other improvements on steep slopes shall provide " <br /> adequa.te information to allow the city to evaluate possible soil erosion impacts and <br /> development of[sic] visibility from public waters before such permit may be issued. <br /> When determined necessary, conditions sha11 be attached to issued permits to prevent <br /> erosion and preserve existing vegetation screening of structures, vehicles and other <br /> facilities as viewed from the surface of public waters, assuming summer, leaf-on <br /> vegetation. <br />
