The issues are whether the structure meets the 30 feet <br /> height standard or the three story height requirement since the basement is an oddity, does it fit into <br /> the neighborhood and is there a reason to grant a variance. <br /> " Curtis stated the structure does meet the 30-foot height limitation. <br /> Alexander stated the intent is to remodel the house and that they are actually adding garage space with � <br /> a flat terrace over it. Alexander stated the need for the variance is because the house, as is sits,is <br /> closer to the lake than 75 feet. Alexander stated the house currently sits five feet from the side lot line. <br /> Alexander indicated they have submitted letters from the neighbors expressing their support of the <br /> project. Alexander stated there is not a problem with drainage on the property. <br /> Beck stated the drainage runs back towards the street. <br /> Rahn inquired whether the five foot setback is the bump-out on the side. ' <br /> . Alexander stated it is and that it is existing. <br /> . Rahn inquired whether they are going up at that location. <br /> Alexander stated they are going up at that location. . <br /> Rahn stated he would have an issue with adding to a nonconformity. <br /> Kempf stated the house is located too close to Lake Minnetonka and that this is one of those times the <br /> applicant would be creating a substantial structure on top of a bad foundation: Kempf stated in his <br /> opinion this is a hardship lot and there is little room to construct but that he would hate to see more <br /> structure added on to the existing foundation. � <br /> Zullo stated the owners purchased the property as it is and that the Becks were aware of the hardship <br /> when they acquired the property: <br /> Gaffron inquired how long the property has been in the family. <br /> Beck stated since 1946. � <br /> Gaffron stated in this case this is not a new buyer since it has been in the family for many decades. <br /> Alexander stated the owners specifically wanted to retain some of the rooms on the main level,such as <br /> the fireplace,the sunroom and the living room, and they went to great lengths to design around that. <br /> PAGE 21 <br />
