MINUTES OF THE <br /> ORONO PLANNING COMMISSION <br /> Monday,July 17,2006 <br /> 6:00 o'clock p.m. <br /> (#06-3214 Rudy Wicklander Homes, Continued) <br /> Jon Hofer, 3339,Crystal Bay Road, stated he is in favor of the new house and that the other new houses <br /> in the area have helped to improve the neighborhood. <br /> Tom Anderson, 3349 Crystal Bay Road,noted the setback is now at 10 feet and that the average setback � <br /> is also fine, so he would be in support of the project. <br /> Bremer closed the public hearing at 9:45 p.m. <br /> Bremer stated the issue is the definition of a story. Bremer indicated she likes the design of the house. <br /> Curtis stated the height of the structure is conforming but the number of stories is the issue. <br /> Hoarn stated the basement is not as buried because there is less dirt in that area and that there is now a <br /> question over whether it would still be considered a basement. <br /> Curtis stated the most recently plan steps down from the garage level into the basement,making the <br /> basement level�933',which is the required elevation for a basement. Curtis stated there is a step up into <br /> the first story. . <br /> Jurgens inquired whether there is a concern with water coming into the basement since it is located below <br /> street leveL • <br /> Curtis stated the basement is not located below the street level but the garage is. <br /> Hoarn stated they are allowed to construct a basement below street level according to building code. <br /> Jurgens stated it looks like a nine-foot basement. <br /> Hoarn stated they had to drop the basement floor 16 inches. Hoarn stated depicted on Exhibit D-3 there is <br /> a gasketed threshold on the door going from the garage into the foyer to address the issue of water. <br /> Jurgens inquired whether the applicant should work further with Staff on the basement and lower level. <br /> Curtis stated what the applicants have proposed with the basementJlowest floor level would be considered <br /> a basement and that the question is whether or not the Planning Commission feels the structure meets the <br /> story limitations. <br /> Bremer stated if the basement were dug out further to 933',there would be no question with the <br /> application. Bremer stated there is a lesser visual impact with the lower garage. <br /> PAGE 29 <br />
