MINUTES OF THE . <br /> ORONO PLANTTING COMIVIISSION MEETING ' <br /> Monday,March 19,2007 <br /> 6:00 o'clock p.m. <br /> (#06-3249 City of Orono,Continued) <br /> Kroeger stated he has a difficult time approving the comprehensive plan amendment given its current <br /> language and that he would like to see the zoning open on this site. <br /> Gaffron stated the Planning Commission should make a recommendation on whether or not to revise the <br /> Comprehensive Plan back to what it was pre 2004,which would eliminate the pharmacy use, and <br /> whether or not the zoning should change from RR-1B to B-6 PUD or B-6. Gaffron stated if the ' <br /> Planning Commission feels that there is some other type of zoning that would be more appropriate than <br /> B-6 for this site,they could make that recommendation. Gaffron noted the B-6 PUD zoning would . <br /> allow retail on the site and the B-6 zoning would not allow retail. � <br /> Zullo stated the political process is that the Council hears through applications the desires of the citizens <br /> but that she is not necessarily in agreement with acting on the Comprehensive Plan Amendment tonight <br /> � and zoning it B-6. <br /> Kempf stated he would like to proceed forward with recommending approval of the comprehensive plan <br /> amendment. <br /> Kempf moved,Winer seconded,to recommend approval of rezoning Outlot A,Stonebay,to B-6 <br /> PUD,Aighway Commercial District. VOTE: Ayes 4,Nays 3,Kroeger,Kang and Zullo opposed. <br /> ' Winer moved,Kempf seconded,to recommend approval of Application#06-3249, City of Orono, � <br /> Proposed Comprehensive Plan Amendment,Outlot A,Stonebay,and to rezone the site from RR- � <br /> 1B, Single Family Rural Residential,to B-6 PUD,Highway Commercial District,with the <br /> recommendation that special consideration being given to aIIowing a bank and a food co-op on <br /> this site. VOTE: Ayes 5,Nays 2,Kroeger and Kang opposed. <br /> 5. � 07-3255 CATHERINE SWEET,3405 CRYSTAL BAY ROAD,VARIANCE,7:42—8:00 <br /> P.M. � <br /> Catherine Sweet,Applicant,was present. <br /> Turner stated the applicant is requesting a setback variance to construct a replacement garage with a <br /> two-foot setback from the westerly side property line when a 15-foot setback is required. A variance to <br /> allow hardcover in the 0-75 foot zone and more than 25 percent hardcover in the 75-250 foot zone is <br /> also requested. . <br /> The west wall of the proposed garage is proposed to be 2.0 to 4.7 feet from the street right-of-way. At <br /> the corner closest to the property line,the eave would be about 12 inches from the property line. <br /> Because it is a street,the required setback would be 15 feet. If the property were not a street,the <br /> required setback would be 10 feet. Since the wall is within three feet of the property line,the building <br /> PAGE 11 . <br />
