The City Council has considered this application iiicluding the findings <br /> and recoininendation of tlle Plaiuiiiig Conuiiission, repox-ts by City staff, <br /> comments by the applicants ai�.d the puUlic, and the effect of the proposed <br /> variance on the liealtl�., safety and welfare of the coinmuiuty. � <br /> � 5. Tlle City Couticil finds that the conditions existing on this property are <br /> peculiar to it and do not apply generally to ofiher property in this zoiui�g <br /> district; that graiiting the variauce would not adversely affect traffic <br /> coiiditions, light, air nor pose a fire hazard or other danger to neighboring <br /> property; rvotild ilot merely seive as a co.nvenieilce to the a�plicants, but is <br /> ilecessary to alleviate a deinoiistrable hardsllip or difficulty; is necessary to � <br /> preseive a suUstantial property right of the applicants; aud would be in <br /> keepiiig witlz the spirit and intent of the Zoniiig Code and Coinpreliensive <br /> Plan of the City. <br /> CONCLUSIONS, ORDER AND CONDTTIONS <br /> Based upou one or more of the above findings, the Orono City Cotu�.cil hereby <br /> grants a variance to Oroi�o Mttnicipal Zoning Code Section 78-305 Subdivision B to <br /> allow a side setback of 10' where 30' is nonnally required for the constiliction of a ne4v <br /> attached garage and a variance to Orono Municipal Zoning Code Section 78-1279 <br /> Subdivision 6 to allotiv an existing decic to be recoilstructed tivithin the average lakeshore <br /> setback, and denies a variance to Municipal Zoning Code Section 78-1288 for hardcover <br /> in excess of the allowed 25%in the 75' —250' zone sttbject to the followin�conditions: <br /> � 1. Council approval is based on the site plan submitted by the applicants and <br /> aiuiotated by City staff, att�ched to this Resohition as ExhiUit A. Any <br /> �nendmenis to the site plan whicli are not iii cozifonility with City codes will <br /> require further Plauning Cormi7ission and City Council revie�v. <br /> 2, Hardcover iii the 0-75' zone shall not increase above the level of 59% or 4,230 s.f. <br /> (C.S.A.H. 15). Hardcover in the 75-250' zone shall be limified to 4,903.5 s.f. or <br /> 25% per tlie proposed plan and hard'cover allotivance summary as depicted ou <br /> . Exhibit A.
