"The conditions do not apply generally to other land or structures in the district in <br /> which said land is located." <br /> The applicant is not aware of other property in the district that might be affected by <br /> the same conditions and believes that the circumstances described in this request <br /> to be generally unique to the subject property. <br /> 10. "The granting of the application is necessary for the preservation and enjoyment <br /> of a substantial property right of the applicant." <br /> It is the applicant's desire to design and develop the subject property in a manner <br /> consistent with the City's existing Zoning Code and Land Use Plan. Granting the <br /> requested variance will allow the developer to achieve reasonable access to, and <br /> use of the property, and to meet the density and design standards of the City's <br /> Code. <br /> 11. "The granting of the proposed variance will not in any way impair health, safety, <br /> comfort, morals, or in any other respect be contrary to the intent of the Zoning <br /> Code." <br /> The applicant is not aware of any negative impacts associated with the granting of <br /> this variance request. A traffic study has been completed by RLK Incorporated, <br /> which includes the requested 50-foot right-of-way for Outlot A. Traffic movement <br /> and circulation are accommodated within the 50-foot right-of-way that is being <br /> requested. <br /> � 12. "The granting of such variance will not merefy serve as a convenience to the <br /> applicant, but is necessary to alleviate demonstrable hardship or difficuliy." <br /> As demonstrated above, the requested variance is necessary to provide reasonable <br /> access to the subject property and to a(low for reasonable use of the subject <br /> property consistent with the City's existing Zoning Code density and design <br /> standards.
