If it is the corner lot, it will access from the new driveway to Old <br /> Crystal Bay Road and from the existing driveway to Wayzata Boulevard. If it is the large <br /> building the outdoor storage associated with the metal building will be relocated to the east <br /> side of the existing building. This will allow the new street to be constructed. It will provide <br /> access to the new building and to the existing building. <br /> The second building constructed will be other of the two buildings that could be constructed <br /> first. The third building will be constructed no earlier than 2010, which is when the current <br /> lease for the metal building ends. <br /> Until the metal building is removed building code requirements may require L1B1 and L3B1 <br /> be combined to avoid the building being split between two parcels. <br /> ------------------------------------------------------------------------------------------ <br /> Revision to Conditional Use Permit for Outdoor Stora�e: The applicant also made <br /> application to revise the current conditional use permit for outdoor storage associated with <br /> the metal building to reflect the new legal description. This is unnecessary since the location <br /> of the storage will not change. An encroachment pernut will be required because some of it <br /> will be in the new street right of way. The misunderstanding occurred because in initial <br /> discussions the applicant indicated the outdoor storage would be relocated immediately. The <br /> application should be withdrawn and resubmitted when the relocation is imminent. That <br /> application will need to address how the metal building tenant will move between the . <br /> building and the outdoor storage area. The outdoor storage of boats will end when that <br /> tenant's lease in the existing building ends next spring. � <br /> Other Issues for Consideration <br /> Should the metal building be removed when the current lease ends even if the new building <br /> will not be constructed immediately? <br /> Should public sidewalk or trail be required any place within the development? The trail <br /> along Old Crystal Bay road will remain. <br /> Are there any other issues or concerns with this application? <br /> Staff Recommendation <br /> Planning Staff recommends that approval of the preliminary plat subject to providing a <br /> 70 foot right of way for the new street and complying with the other requirements of the <br /> subdivision regulations. <br /> Staff recommends approval of the site plan and conditional use permit for building materials <br /> subject to the following: <br /> 1. The site plan being adjusted to accommodate the 70 foot right of way without <br /> creating any variances. <br />
