Nonconforming Uses/Structures . <br /> November 13,2003 <br /> Page 2 . <br /> Current Status � <br /> During 2003 an amendmeilt of the Noiiconforming Uses section(10.03 Subd. 5, now recodified as <br /> Section 78-71) was drafted to reorganize that sectioll and add standards speci.fically addressiilg <br /> izonconforming structures. Planning Commission reviewed the latest draft on November 5 ai�d <br /> suggested a number of fizrther revisions and slight reorganization. <br /> The current draft reflects the Planning Commission recornmendations and includes additional <br /> paragraph titles for clarity. The current draft is organized as follows: <br /> Title: Nonconfornuiig Structures and Uses <br /> A. General Provisioils <br /> (1) Purpose staternent <br /> (2) Effective date <br /> (3) Safety Repairs � _ <br /> B. Nonconforming Uses � <br /> (1) Change to Conforming Use . <br /> (2) Chan�e to New Nonconforrnulg Use <br /> (3) Relocation of Nonconforming Use <br /> (4) Decrease in Nonconfonning Use <br /> (5) Discontinuation of Nonconforming Use <br /> (6) Normal Maintenance . <br /> (7) Alterations to Lawful Nonconfonming Dwelling Units <br /> C. Nonco�zforming Structures � <br /> (1) Involuntary Damage or Destntction � <br /> (2) Voluntary Destruction <br /> (3) Expansion of Residence Structures <br /> (4) Expansion of Accessory Structures <br /> (5) Relocation � � <br /> (6) Prior Permit � <br /> The cunent draft accomplishes the following siguficant revisions: <br /> - It separates the provisions pertaining to "Nonconforming Uses" from those pertaining to <br /> "Nonconfonning Structures"; <br /> - It elimuiates the `36-months after 1-1-75' sunset provision for lawful nonconforming use of: <br /> 1) land not involving a structure or 2)involving a structure with value less than$3000 on 1-1-75 <br />
