VOTE: Ayes 5, Nays 0. <br />*5. #08 -3370 KEVIN AND BARB DULIN, 1785 CONCORDIA STREET — CONDITIONAL <br />USE PERMIT EXTENSION — RESOLUTION NO. 5879 <br />Bremer moved, Murphy seconded, to adopt RESOLUTION NO. 5879, a Resolution Granting a <br />Conditional Use Permit for Floodplain Rearrangement per Orono Code Section 78 -1116. VOTE: <br />Ayes 5, Nays 0. <br />6. #09 -3405 FRANK MASSERANO III ON BEHALF OF INTERNATIONAL MINISTERIAL • <br />FELLOWSHIP, 2477 SHADYWOOD ROAD — VARIANCES AND CONDITIONAL USE PERMIT <br />— RESOLUTION NO. 5880 <br />McMillan noted the required church setback is 50 feet, with the setbacks for office buildings being 35 feet. <br />McMillan asked why the deck could not meet the 35 -foot setback. <br />Curtis stated the applicant has reduced the size of the deck from their original proposal. <br />Frank Masserano, Pastor of International Ministerial Fellowship, indicated the available footage is 21 feet <br />and 2 inches across the board in the back due to a handicap ramp that is located on the back of the church. <br />In the City of Fridley, where the church has been located for the past 28 years, they do not count the <br />handicap ramp towards the setback but it is included in Orono's setback calculation. Masserano noted the <br />deck would be used mainly during funerals. <br />Murphy moved, Franchot seconded, to adopt RESOLUTION NO. 5880, a Resolution Granting <br />Variances to Municipal Zoning Code Sections 78 -736 and 78 -1288 and An Amendment to Resolution <br />No. 4674 for a Conditional Use Permit Pursuant to Municipal Zoning Code Section 78- 734(11). <br />VOTE: Ayes 5, Nays 0. <br />7. #09 -3423 HARVEST MOON NATURAL FOOD CO -OP ON BEHALF OF CLIFFORD <br />OTTEN, 2380 WAYZATA BOULEVARD WEST — PUD AMENDMENT #3 AND VARIANCE <br />Gaffron noted this application was heard at the October 12, 2009 City Council meeting. Council directed <br />staff to draft an amendment to PUD No. 1 to include retail foods as a permitted use and to grant a variance <br />for parking.
