CITY OF ORONO <br />RESOLUTION OF THE CITY COUNCIL <br />NO. 664 1 - <br />WHEREAS, the Orono City Council reviewed the proposed lot line <br />rearrangement at a regular meeting held on July 11, 2016 and makes the following findings with <br />regards to the proposed lot line rearrangement: <br />FINDINGS <br />1. This application was reviewed as Zoning File #16-3834. <br />2. The Dau Property contains 0.17 acre in total area and currently contains a single family <br />residence. <br />3. The HOA Property contains 4.71 acres in total area and is currently vacant and used as <br />open space for the Northgate Two development. <br />4. The properties are served by municipal sewer and water. <br />5. This application contemplates a lot line rearrangement to relocate the common boundary <br />between the two properties via an equal trade of 75 square feet, such that each property <br />maintains the existing parcel areas. <br />6. The application also contemplates the vacation of a portion of an existing open space <br />easement within the HOA Property, and dedication of an open space easement over a <br />portion of the Dau Property, equal in area to the portion of the HOA Property being <br />vacated. <br />7. Because this is a lot line rearrangement which results in no additional lots, no park fee or <br />stormwater trunk fee will be required. <br />CONCLUSIONS, ORDER AND CONDITIONS <br />NOW, THEREFORE, BE IT RESOLVED, that based upon one or more of the <br />findings noted above, the City Council of the City of Orono hereby grants the lot line <br />rearrangement of the above referenced properties based on the lot line rearrangement survey <br />dated June 24, 2016, by Gregory R. Prasch of Lot Surveys Co. attached as Exhibit A, subject to <br />the following conditions: <br />1. Following the lot line rearrangement the properties shall be legally described as shown in <br />Exhibit B attached denoting Parcels A and B as the land portions being traded and <br />Parcels 1 and 2 as the final descriptions after the lot line rearrangement has been <br />completed. <br />Page 2 of 3 <br />
