MINUTES OF THE <br />ORONO CITY COUNCIL MEETING <br />Monday, January 26, 2009 <br />7:00 o'clock p.m. <br />(4. 2009 FEE SCHEDULE, Continued) <br />Bremer moved, Franchot seconded, to adopt SUAINL4,RY OF ORDINANCE NO. 53, Third Series, <br />and ORDINANCE NO. 53, Third Series, an Ordinance Adopting the 2009 Fee Schedule and <br />Repealing Ordinance No. 40, Third Series. <br />Murphy reported that in today's news it was announced that the United States experienced another 68,000 <br />more layoffs. Murphy commended the City Staff and City Council with the way they have dealt with the <br />budget, but indicated he is not happy that the City is being put in a situation that requires it to increase all <br />its fees. Murphy noted the fees have not been raised since 2004, but that it is unfortunate given today's <br />economic climate that the City has had to make this difficult choice and increase fees. <br />VOTE: Ayes 4, Nays 1, Murphy Opposed. <br />APPROVAL OF MINUTES <br />*5. VOTE: Ayes 5, Nays 0. <br />i <br />=A <br />• <br />PLANNING COMMISSION COMMENTS — TESS RICE, REPRESENTATIVE • <br />Rice stated she had nothing to report but would be available for questions. <br />PUBLIC COMMENTS <br />None <br />ZONING ADMINISTRATOR'S REPORT <br />6. #08 -3381 BARRY TANNER, 3435 SHORELINE DRIVE — CONDITIONAL USE <br />PERMIT — RESOLUTION NO. 5803 <br />Barry Tanner, Applicant, was present. <br />Turner noted that this item was tabled at the January 12ffi City Council meeting. Staff was directed to <br />draft a resolution granting the conditional use permit for consideration once colored building elevations <br />and a revised lighting plan had been received. The applicant has submitted the elevation drawings and the <br />- applicant will be bringing color samples to tonight's meeting. <br />The Planning Staff recommends that the applicant be required to illuminate the parking lot during <br />operating hours in such a way that the lighting creates 0 foot candles at the south property line and a <br />minimum level for safety or direction at the east property line where the driveway and street intersection • <br />PAGE 2 of 11 <br />
