CITY OF ORONO <br />RESOLUTION OF THE CITY COUNCIL <br />NO. 66 3 <br />A RESOLUTION GRANTING <br />GENERAL DEVELOPMENT PLAN APPROVAL <br />FOR PLANNED UNIT DEVELOPMENT NO. 11 <br />FOR ESTATE DEVELOPMENT CORPORATION <br />AND APPROVING THE PLAT OF ORONO PRESERVE <br />- FILE #16-380713842 <br />WHEREAS, the City of Orono is a municipal corporation organized and existing <br />under the laws of the State of Minnesota; and <br />WHEREAS, the City Council of the City of Orono (hereinafter "City Council") <br />has adopted subdivision and land development regulations for the orderly, economic and safe <br />development of land within the City; and <br />WHEREAS, Estate Development Corporation (hereinafter the "Developer") owns <br />or has an interest in the three properties at 425 thru 595 Old Crystal Bay Road North including <br />Hennepin County PINS 33-118-23 24 0001, 33-118-23 24 0002, and 33-118-23 24 0003, said <br />properties legally described in Exhibit A attached hereto (hereinafter the "Property"); and <br />WHEREAS, the City Council has considered the application by the Developer for <br />rezoning the Property to RPUD - Residential Planned Unit Development as well as subdivision <br />and development of the Property by the Planned Unit Development (PUD) process; and <br />WHEREAS, on April 11, 2016 the City Council adopted Resolution No. 6603 <br />granting General Concept Plan Approval and Preliminary Plat Approval for the proposed <br />development, which approval includes the following elements: <br />1. Subdivision platting of the Property to create 39 developable single family residential <br />building lots to be served by new public roads and municipal sewer and water; <br />2. Rezoning of the property from RR -1 B Single Family Rural Residential District to RPUD <br />Residential Planned Unit Development District; and <br />3. PUD conditions for development of single family residences on the thirty-nine residential <br />lots; and <br />WHEREAS, the Developer has agreed to execute the Planned Unit Development <br />No. 11 Agreement providing for the installation of certain improvements as a condition of site plan <br />Page 1 of 7 <br />
