A 10' side yard setback is required for structures in that zoning <br /> district. The survey you submitted shows a 6.5' setback. Although you are replacin�r an <br /> existing porch, once the old porch is removed, the new construction is required to meet <br /> setbacks. <br /> Therefore, the City must require you to remove the encroachment or if you feel you have a <br /> hardship, you may apply to City Council for a variance. Because this is an after-the-fact <br /> situation, the City must require removal or variance application submittal before December 15, <br /> 1994.
