MINUTES OF THE <br />ORONO CITY COUNCIL MEETING <br />Monday, November 8, 2004 <br />7:00 o'clock p.m. <br />(8. #04 -3054 JONAND GAIL BLACKSTONE, 4475 FOREST LAKE LANDING, <br />Continued) <br />Gaffron suggested requiring removal of the shed prior to the issuance of a certificate of occupancy. <br />Gaffron stated one further issue concerns the driveway being relocated to the north in order to comply <br />with the grading plan, which may necessitate relocating the shed approximately 20 feet. <br />Jon Blackstone indicated they are in favor of the grading plan, which helps to alleviate the steepness of <br />the driveway. <br />Gaffron noted there might need to be some minor changes to the wording of the resolution to <br />accommodate what was discussed tonight. <br />Gail Blackstone stated the fee on their application was almost doubled for the variance, noting that this <br />application was only two feet shy of being administratively approved except for the shed. Blackstone <br />requested the Council consider a staggered fee structure to deal with applications that are simpler in <br />nature. <br />White moved, McMillan seconded, to adopt RESOLUTION NO. 5247, a Resolution Granting a Lot <br />Width Variance for Jon and Gail Blackstone, 4475 Forest Lake Landing, with the condition the <br />accessory building be removed prior to the issuance of a certificate of occupancy. VOTE: Ayes 4, <br />Nays 0. <br />9. #04 -3055 DR. MARTHA SPENCER, 1005 WILLOW DRIVE SOUTH — VARIANCES • <br />Mark Ritter appeared on behalf of Dr. Martha Spencer. <br />Curtis stated the applicant is requesting a hardcover variance within the 0 -75' setback to allow 11.7 <br />percent hardcover. This application was tabled at the last City Council meeting at the applicant's request. <br />To date no revisions have been submitted to the original plan. In addition, during discussions with the <br />Planning Commission and Council the applicant has stated that there is a 10.5' by 25' dog kennel on the <br />property that was not included in the hardcover calculations. Staff feels the dog kennel is further <br />justification for not granting the hardcover variance. Curtis suggested Council discuss whether the <br />previous variance approval should be amended or whether the dog kennel should be removed in order to <br />achieve the 8 percent level approved with the 2004 variance. <br />The Planning Commission voted 7 -0 to recommend denial of the hardcover and setback variances based <br />on lack of sufficient hardship. Staff also recommends denial of the application. <br />Ritter inquired whether the Council would allow a paver called Neco- Paver. Ritter noted this type of <br />paver allows permeation of water through it. Ritter stated they would like to utilize these pavers for the <br />walkways and that they would be willing to remove the dog kennel. <br />Curtis stated removal of the dog kennel would bring the property back to the approved level in 2004. <br />Ritter inquired why the dog kennel was not included in the original calculations. <br />• <br />PAGE 8 <br />
