Council approval is based on the site plan submitted by the applicants and <br /> annotated by City staff, attached to this Resolution as Exhibit A. Any <br /> amendments to the site plan which are not in conformity with City codes will <br /> require further Planning Commission and City Council revie�v. <br /> 2. The new deck shall be of the same size as the existin� deck and may be shifted to <br /> the north a few feet to accomplish a safer exit to the stair case. <br /> 3. Hardcover in the 0-7�' zone shall not increase above the 4.56%. Hardcover in the <br /> 7�-2�0' zone shall be limited to 3,558 s.f. or 38.2% per the proposed plan and <br /> hardcover allowance summary as depicted on Exhibit�. Applicants are advised <br /> that any future requests to increase hardcover or chanQe the nature of <br /> esisting/approved hardcover shall require City appro��al, and increases in <br /> hardcover w�ill not likely be approved without concurrent reduction in existing <br /> hardcover. <br /> 4. The applicants are advised that the esisting shed along the northern property line <br /> is non-conforming in location as it should be setback 10' from all property lines <br /> and other structures, and any future replacement of that shed will be required to <br /> be in a conforming location. <br /> 5. Applicants shall remove all plastic or fabric liner material from the decorative <br /> landscape beds on the prope�-ty to ensure their permeability as non-hardcover <br /> surfaces. <br /> 6. Authorities granted by this resolution run with the property not with the <br /> applicants, but are permissive only and must be exercised by obtaining a building <br /> permit for the new construction within one year of the date of Council approval, <br /> or the variance will expire on that date (September 22, 200�). <br /> 7. `'iolation of or non-compliance �vith any of the terms and conditions of this <br /> resolution shall constitute a violation of the zoninQ code, shall automatically <br /> terminate any authority granted herein, and shall be punishable as a misdemeanor. <br /> 8. The undersigned applicants have read, understand and hereby a?ree to the terms <br /> of this resolution and on behalf of the applicants and the applicants' heirs, <br /> successors and assi�s, hereby a�ee to the recordin� of this resolution in the <br /> chain of title of the property. <br /> Pa�e 3 of 5 <br />
