� O� <br /> O � <br /> ' �� - CITY of ORONO <br /> � � � <br /> �� `��', � G~' RESOLUTION OF THE CITY COUNCIL <br /> L`�kEsKo4'� rvo. � 8 � l. <br /> A RESOLUTION RENEWING A VARIANCE <br /> TO MUNICIPAL ZONING CODE <br /> SECTION 78-330 <br /> FILE NO. 09-3429 <br /> WHEREAS, Mark James Fuller, Stacey Michelle Nakay�a, and Karen <br /> Lynn Fe,yo (hereinafter "Owners") are the owners of the property located at 405� Elm Street <br /> within the City of Orono (hereinafter "City") and le�ally described as: Lots 7, 8 ai�d 9, Block <br /> 9, Minnetonka Summit Park, Hennepin County, Minnesota(hereinafter "the Property"); and <br /> WHEREAS, the Owners have made application to the City for a renewal of a <br /> variance to Municipal Zoning Code Section 78-330 to allow construction of a new house on a <br /> lot that is 0.44 acre in area and 120 feet wide when an area of 1.0 acre and a width of 140 feet <br /> are required; and <br /> WHEREAS, after due published notice and mailed notice in accordance with <br /> Minnesota Statutes and the City of Orono Zoning and Planning Codes, the Orono Planning <br /> Coinmission held a public hearing on October 19, 2009, at which times all persons desiring to <br /> be heard concerning this application were given the opportunity to speak thereon. <br /> NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono, <br /> Minnesota: <br /> FINDINGS <br /> l. This application was reviewed as Zoning File #09-3429. <br /> 2. The property is located in the LR-1B zonin� district, where 1 acre is the <br /> minimum lot area and 140 feet is the minimum lot width. The property is <br /> approximately 0.44 acre in area and 120 feet in width. <br /> 3. The Planning Commission reviewed the application on October 19, 2009 on a <br /> vote of 5 - 0 recoinmended approval of the variance, based on the following <br /> findin�s: <br /> a.
