� o� <br /> O �,�� O CITY of ORONO <br /> �;�_, <br /> � � � <br /> � `� � ' 4�, �+ RESOLUTION OF THE CITY COUNCIL <br /> '�,�, ,� y'� ::��" G,� 6 1 7 2 <br /> NO. <br /> ��kEsHog'� . <br /> A RESOLUTION GRANTING VARIANCES <br /> TO MUNICIPAL ZONING CODE <br /> SECTION 78-330 <br /> FILE NO. 12-3572 <br /> WHEREAS, Matthew Dwight Fritz and Kristine Murphy Fritz a married <br /> couple (hereinafter "Applicants") are the owners of the property located at 4055 Elm Street <br /> within the City of Orono (hereinafter "City") and legally described as: Lots 7, 8 and 9, Block <br /> 9, Minnetonka Summit Park, Hennepin County, Minnesota (hereinafter"the Property"); and <br /> WHEREAS, the Appiicants have made application to the City for variances to <br /> Municipal Zoning Code Section 78-330 to allow construction of a new house on a lot that is <br /> 0.44 acre in area and 120 feet wide when an area of 1.0 acre and a width of 140 feet are <br /> required; and <br /> WHEREAS, after due published notice and mailed notice in accordance with <br /> Minnesota Statutes and the City of Orono Zoning and Planning Codes, the Orono Planning <br /> Commission held a public hearing on September 17, 2012, at which times all persons <br /> desiring to be heard concerning this application were given the opportunity to speak thereon. <br /> NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono, <br /> Minnesota: <br /> FINDINGS <br /> 1. This application was reviewed as Zoning File #12-3572. <br /> 2. The Property is located in the LR-1 B zoning district, where 1 acre is the <br /> minimum lot area and 140 feet is the minimum lot width. The Property is <br /> approximately 0.44 acre in area and 120 feet in width. <br /> 3. The Planning Commission reviewed the application on September 17, 2012 <br /> and on a vote of 7 - 0 recommended approval of the variances, based on the <br /> foliowing findings: <br /> a. The parcel was created before there were subdivision regulations. <br /> b. There is no adjacent property the Applicants could acquire to enlarge <br /> the lot. <br /> c. There are numerous similarly sized lots with houses in the immediate <br /> vicinity of this Property. <br /> Pa�e 1 of 4 <br />
