i .:� . . . <br /> ' Clt� o� ORONO� . � <br /> ,�� RESOLUTION OF THE CITY COUNCIL � <br /> • NO. 2688 <br /> • ' • • <br /> � A R$SOLIITION GRANTING <br /> A VARIANCE TO <br /> MIINICIPAL ZONING CODE <br /> SECTION 10.55, SDBDIVISION 8 AND <br /> GRANTING A CONDITIONAL DS$ P$RMIT PER <br /> SECTION 10.03, SDBDIVISION 19 <br /> FII.$ #1433 <br /> WHER$AS , Loren Butterfield (hereinafter "the <br /> applicant" ) is the owner of the property located at 3925 <br /> Watertown Road within the City of Orono (hereinafter "City") and <br /> legally described as follows: <br /> Exhibit A (hereinafter "the property"); and <br /> WHEREAS, per Section 10.03, Subdivision 19, Section <br /> 10.55, Subdivision 8 and Orono Resolution #2610 (Condition No. <br /> 15 ) , the applicant has made application to the City of Orono to <br /> � permit the annual excavation/removal of peat from the wetlands <br /> located within the property on the south of the Luce Line Trail. <br /> NOW, THERSFOR$, BE IT RESOLV$D by the City Council of <br /> Orono, Minnesota: <br /> FINDINGS <br /> l. This application was reviewed as Zoning File #1433 <br /> 2. The property is located in the RR-lA Single Family <br /> Lakeshore Residential Zoning �District requiring 5 acres of <br /> area, 2 acres of which must be contiguous. The property <br /> consists of a total of 20.56 acres. <br /> . 3. The Orono Planning Commission reviewed this application <br /> on August 21, 1989 and recommended approval of the proposed <br /> variance and conditional use permit, based on the following <br /> findings: <br /> A) Per Orono Resolution #2610, Condition 15, the <br /> applicant was directed to file a conditional use permit <br /> for the annual removal of peat used in the commercial <br /> growing of plants on the property. <br /> � B) In a report dated August 17, 1989 by Glenn Cook, he <br /> noted that "the continued excavation of the wetland . . <br /> . on a limited scale (300 cubic yards) will have a <br /> minimal effect on the marsh" . <br /> Page 1 of 5 <br /> ,� <br />
