The City Counci 1 f inds that the conditions existing on <br /> this property are peculiar to it and do not apply generally <br /> to other property in this zoning district; that granting the <br /> variances would not adversely affect traffic conditions, <br /> light, air nor pose a fire hazard or other danger to <br /> neighboring property; would not merely serve as a <br /> convenience to the app Iicant, but is necessary to alleviate <br /> a demonstrable hardship or difficulty; is necessary to <br /> " preserve a substantial property right of the applicants; and <br /> would be in keeping with the spirit and intent of the Zoning <br /> Code and Comprehensive Plan of the City. ' <br /> CONCLQSIONS, ORDER AND CONDITIONS <br /> Based upon one or more of the findings noted above, the <br /> Orono City Council hereby grants a variance to Municipal Zoning <br /> Code Section 10.22, Subdivisions 1 and Section 10.55, Subdivision <br /> 8 to allow construction of a new foundation under the existing <br /> • house and a new attached garage addition, both located 58' from <br /> the shoreline of Lake Minnetonka where a 75' setback is normally <br /> required, and a variance to Section 10.22, Subdivision 2 to allow <br /> hardcover in the 0-75' and 75-250' Iakeshore zones in excess of <br /> the hardcover amounts normally required in those zones, and <br /> variances to Section 10.25, Subdivision 6 (B) to allow a side <br /> yard setback of 4.6' to the west side Iot line and 3' to the east <br /> side Iot line where 10' side Iot Iine setbacks are normally <br /> required, and to allow a 7' street setback where a 30' street <br /> setback is normally required, subject to the following <br /> condi�tions: <br /> 1. Hardcover on the property shall be limited to the <br /> following: <br /> 0-75 ' Zone: (Area of zone = 4,556 s.f. ) • <br /> House & Garage 924 s.f. <br /> Basement Access 109 s.f. <br /> Steps 6 s.f. <br /> Sidewalk 65 s.f. <br /> Misc.
