� � <br /> , t� : c�t� o� oR,oNo <br /> • � RESOLUTION OF THE CITY COUNCIL , <br /> � -- NO. 2624 <br /> • - • • <br /> A R$SOLIITION VACATING <br /> • AN UNQSED PORTION OF SPRING HILL ROAD <br /> - - (FOR1K$RLY CODNTY ROAD 6) <br /> SECTION 25, TOWNSHIP 118 NORTH, RANGE 23 WEST <br /> CITY OF ORONO, H$NNEPIN CODNTY, MINNESOTA <br /> . . • WHEREAS, the City of Orono is a municipal corporation organized <br /> and existing under the laws of the State of Minnesota; and <br /> WHEREAS, on January 27, 1989, George H. Partridge filed a <br /> . petition with the City of Orono requesting the vacation of a portion of . <br /> Spring Hill Road legally described as follows: . <br /> � � Refer to Exhibit A; attached. � <br /> WHER$AS, after due published and posted notice, a public hearing <br /> was held before the Planning Commission on February 21, 1989 regarding said <br /> vacation and all interested persons were given an opportunity to be heard; <br /> .nd <br /> WHEREAS, after due standing and consideration, the Planning <br /> Commission recommend approval of the requested vacation and the Council of <br /> the City of Orono finds that said vacation as proposed, is in keeping with <br /> the public interest in consideration of the following findings: <br /> . . 1. � The vacation does not affect the access or use of adjoining <br /> properties. <br /> 2. The City has not and does not intend to develop, improve Qr use <br /> the portion of the dedicated right-of-way to be vacated for road <br /> purposes. <br /> . 3. The City has not and does not intend to maintain or install <br /> utilities within that portion of the dedicated right-of-way of Spring <br /> Hill Road. - <br /> 4. The unimproved portion of the dedicated right-of-way as it exists <br /> serves no public purpose except for maintaining the public <br /> drainageway. <br /> � � NOW, TH$REFORE B$ IT RESOLVED, that the petition of George H. <br /> Partridge� is hereby granted and that the portion of Spring Hill Road <br /> legally described above is hereby vacated.
