MCNELLIS & JOHN PRDDDEN <br /> FILR NO. 1368 <br /> WHEREAS, the City of Orono is a municipal corporation organized � <br /> and existing under the laws of the State of Minnesota; and <br /> WHERFsAS, the City Council of the City of Orono (hereinafter "City <br /> Council") has adopted subdivision regulations for the orderly, economic and <br /> safe development of land within the City; and ' <br /> WHEREAS, the City Council has considered the application for a � <br /> subdivision of a , lot line rearrangement by Thomas E. McNel lis and John <br /> Prudden (hereinafter "the applicants") of properties legaZly described on <br /> the Certificate of Survey by Sathre Bergquist Inc., dated March 14, 1989 <br /> and attached to this resolution; and <br /> • WHER$AS, the applicants have completed all requirements of the <br /> City for metes and bounds Class I subdivision of a lot line rearrangement <br /> 'including dedication to the City of drainage and utility easements along <br /> the appropriate lot lines. <br /> NOW, THEREFORE, B$ IT RESOLVED, that the City Conci 1 of the City <br /> of Orono hereby approves the metes and bounds subdivision of a lot line <br /> rearrangement for Thomas E. McNellis and John Prudden according to the <br /> legal descriptions shown on the Certificate of Survey by Sathre Bergquist <br /> Inc., dated March 14, 1989 and attached to this resolution, subject to the <br /> following conditions: ' <br /> 1. Upon approval of this subdivision by the City Council of Orono, the <br /> owner of Parcel X as described in the Certificate of Survey referenced <br /> above must apply to the City for legal combination for tax purposes <br /> with Parcel W as described in that same survey. <br /> 2. Similarly, the owner of Parcel Z must apply�to the City for legal <br /> combination for tax purposes with Parcel Y as described in the survey. <br /> 3. The aforesaid division as shown on the attached Certificate of <br /> Survey shall be filed by the City of Orono with the Hennepin County <br /> Recorder's office on or before October 24, 1989 together with a <br /> certified original copy of this resolution and the above noted <br /> easement document. <br /> • .
