MCWD is working on a partnership with several residents who live around <br /> South Katrina Marsh and along Painter Creek. As part of the partnership, nine residents have agreed to convey <br /> conservations easement to MCWD in return for MCWD replacing two undersized driveway culverts which caused <br /> flooding for the area in 2014. I have attached a map which shows where the proposed wetland and Painter Creek <br /> easements are located. In doing a title records search of these properties,five of them noted City encumbrances that <br /> include wetland/buffer, drainage &flowage, and open space easements.Those five properties are: <br /> 1. Rudd; PID 3011823310004,4575 Spruce Way <br /> 2. Deakins; PID 3011823320007; 100 Town Line Road <br /> 3. Olsen; PID 3011823330005; 4680 Creekwood Trail <br /> 4. Chelberg; PID 3111823210005; 4490 Watertown Road <br /> 5. Huntington Farm HOA; PID 3011823440006; Outlot A <br /> The Districts interest in acquiring these easements is to allow the District the right to implement wetland and creek <br /> improvements. I have attached a draft version of the easement the District is looking to implement. I want to ensure <br /> that the rights be pursued by the District are not in conflict with or diminished by the City's encumbrances on these <br /> properties. I would appreciate the City's review to determine this. If the City concludes there are no conflicts then the <br /> District's legal counsel would like the City to formally recognize that and have the City sign the relevant easements <br /> indication acceptance/subordination. If the City has different ideas on how to document that please let me know. <br /> District staff is looking to get MCWD Board approval on the proposed easements on January 28`h. If possible, I would <br /> appreciate your input and guidance on how to proceed with the easement acceptance by January 215t <br /> As for the culvert replacement I am wondering if a City permit is needed?The culverts are on private property under the <br /> driveways at 4680 Creekwood Trail &4650 Creekwood Trail. Each culvert is a 18-inch CMP and were determined to be <br /> undersized during a modeling analysis the District performed.The District is proposing to replace each culvert with a 36- <br /> inch round culvert. I can send more information on this if needed. <br /> There are more details that I can fill you in on over the phone but thought it would be helpful to get you the map and <br /> easement details first.
