The City Council finds that granting a conditional use <br /> permit to allow the restoration of the caretaicer apartment <br /> within the oversized accessory structure will not be <br /> detrimental to the health, safety and welfare of the <br /> community. <br /> 6e The City Council, has considered this application including <br /> the findings and recommendations of the Planning Commission, <br /> reports by City staff and comments of the applicant and the <br /> affect of the proposed varianr.e and r.onditional use permit <br /> on the health, safety, and welfare of the public, would not <br /> adversely affect light, air nor pose a fire hazard or otrier <br /> danger to neighboring properties , nor �n�ill it depreciate <br /> surrounding property values ancl that the proposea levEl of <br /> use of the property wi 11 be in keeping with the intent and <br /> objectives of the Zoning Code and Comprehensive Flan of the <br /> City. <br /> CONCLUSIONSa ORDER �1ND CONDITIONS <br /> Based upon one or more of the above findings, the Orono City <br /> Council hereby qrants a variance to Municipal Zoning Code Section <br /> 10. 03, Subdivision 9 (C) to allow construction of a 23'x32° addition <br /> to the east side of an existing aversi�ed accessory structure ancl per <br /> Section 10.23, Subclivision 4 (A) grants a conditional use permit for <br /> the renovatzon/remodeling of a caretaker apartment within the <br /> oversized accessory structure subject to the following conditionse <br /> l, Applicant �o execute a covenan� for oversized accessory <br /> structure �o insure area needs i�' property is subdivided in <br /> the futureo <br /> 2o If property is subdivided at a future date, this conditional <br /> us� permit wi11 enpir� an�. th� curr�nt �wner �f n�w lot mus�t <br /> apply for a new conditional use permit for guest house/guest <br /> apartment useo <br /> Page 3 of 6 <br />
