� � �� . <br /> Q , � O <br /> � �� - CITY of OIt01'1T0 <br /> �:v �, <br /> a � ,�.... <br /> . �',� �� G'�'� RESOLUTION OF THE CITY COUNCIL <br /> ��kEST1�4� NO. � � ,�,J � <br /> A RESOLUTION GRANTING <br /> COMMERCIAL SITE PLAN APPROVAL <br /> FOR PLANNED UNIT DEVELOPMENT NO. 3A <br /> FOR ORONO PROFESSIONAL CENTER II <br /> FILE #04-2984 <br /> WHEREAS, the City of Orono is a municipal corporation organized and existing <br /> under the laws of the State of Minnesota; and <br /> WHEREAS, the City Council of the City of Orono (hereinafter "City Council") <br /> has adopted land development regulations for the orderly, economic and safe development of <br /> land within the City; and <br /> WHEREAS, Berkshire Properties ("the Applicants") owns the property located at <br /> 2745 Kelley Park�vay and legally described as: <br /> Lot 1, Block 2, City of Orono Addition, Hennepin County, Minnesota <br /> (hereinafter the "Property"); and <br /> WHEREAS, the City Council has considered the application by the Applicants <br /> for development of the Property by the Plan.ned Unit Development (PUD) process; and <br /> WHEREAS, on March 8, 2004 the City Council granted Commercial Site Plan <br /> Approval for the proposed development consisting of a 36,000 square foot medical office <br /> building; and <br /> � WHEREAS, the Applicants have agreed to execute Planned Unit Development <br /> No. 3A Agreement providing for the installation of certain improvements as a condition of site . <br /> plan approval for the construction of a Office Bttilding on the Property, and which agreement <br /> documents the general and detailed conditions for use atid development of the Property; and <br /> WHEREAS, the Applicants have agreed to grant public easements to the City <br /> over existing and proposed trails and sidewalks within the Property. However, it is specifically <br /> noted that it is the City's goal to locate the proposed trail along Highway 12 within the Highway <br /> � 12 right-of-way, and �vill only make use ok�the easement along Highway 12 if placeinent of trail <br /> in the right-of-way is not possible; and <br /> Page 1 of 6 <br />
