Wetland Ordinance <br /> - August 9,2005 <br /> Page 5 <br /> 6. The orclinance establishes a listing of permitted and conditional uses allowable <br /> within wetlands and wetland buffers; establishes standards for protection of <br /> wetlands and buffer areas; establishes required setbacks from buffers (20'); and <br /> addresses the conformity/nonconformity status of pre-existing improvements, <br /> providing for flexibility in buffer requirements where pre-existing coilditions <br /> make buffer establisluiient difficult or impossible. <br /> 7. The ordinance establishes a permit approval procedure and minimum standards <br /> for alteration of wetlands. <br /> 8. The ordinance establishes a requirement for dedicatioil of wetland and buffer <br /> easements, and for marking of wetland buffers for certain types of development. <br /> 9. The ordinaiice establishes violations as a iiiisdemeanor and lays out procedures <br /> for preventing or remedying violations. <br /> Staff Recommendation <br /> Planning Commission should hold the public hearing, identify any issues that need <br /> fiirther consideration, deteriuine whether any revisions should be made to the draft <br /> ordinance, and make a recommendation to Council regarding adoption of the ordinance. <br /> This is intended to be presented to the Council on August 22 for potential final action and <br /> adoption. <br />
