Due to the staff report not Ueii7g <br /> available until the meeting I was unaUle to receive answers to a number of questions that <br /> are critical to my understanding of the project. I trust that the ai�swers will Ue provided by <br /> your department, to tlle extent you have the infoL7i�.ation, in a timely maiuler thus <br /> allowing the City Council to receive legitimate and accurate discourse regarciing the <br /> applicatioil. My questions are as follows: <br /> 1) How was the nnmicipal lot obtained, by purchase or dedication? From <br /> whom aud whei�? Tf purchased how inuch was paid? Who maintains it <br /> (plowing, sweepiiig, striping, repairs, etc.)? Do the businesses that benefit <br /> pay for the expense? Who izisures it and has liability on t11e property? <br /> 2) With regard to the ma�iy variances sought please describe vi detail the <br /> City's findings of hardship for each in accordance with applicaUle law. <br /> 3) With regard to parking please indicate whether the City will be properly, <br /> in accordance with City Code, developing a parlcing lot striping layout <br /> with legal dimensions in order to detei-mine the true number of spaces <br /> provided in the iilunicipal lot. <br /> 4) Please advise as to the Lot Coverage if the approved patios are inchicied in <br /> the coinptttation. <br /> 5) The site plan shows trees in the sidewallc. Please advise if it is the City's <br /> intent to allow these obstructions in the already too nai-�ow sidewallc and <br /> who will be res�onsible for their maintenance. <br /> 6) Please provide a copy of the City Noise Ordiilance and the appropriate <br /> enforcement official. <br /> 7) Please provide a listing of all police calls regardiilg the Nav�rre Saloon <br /> since opening��itll regard to excessive noise. Also, any police records <br /> detailing enforcement of traffic laws fbr illegal motorcycle mufflers in the <br /> vicinity. Provide the name of tlie appropriate enforcemeilt official for <br /> satne. <br /> 8) As regards the CUP No. 4530 authorizing the Saloon there were six <br /> colzditions. One was tliat the City would review after one year the use of <br /> the building in relation to live entertainment and noise levels geilerated. <br /> Please provide a copy of that report.
