Pillsbury (hereinafter "the <br /> applicant" ) is the owner of the property located at 1200 <br /> Brackett's Point Road within the City of Orono (hereinafter <br /> "City") and legally described as follows: <br /> Exhibit A, attached (hereinafter "the property"); and <br /> WHEREAS, the applicant has applied to the City for <br /> variances to Municipal Zoning Code Section 10.03, Subdivision 15 <br /> (C ) and Section 10.23 , Subdivision 6 (B) to permit the <br /> installation of a 4' high wall within the required front/street <br /> yard where only a 3�' high wall is allowed and located <br /> approximately 3' from the street lot line of Brackett's Point <br /> • Road where a 50' setback is required. <br /> NOW, THEREFORE, BE IT RESOLVED by the City Counci 1 of <br /> Orono, Minnesota: <br /> FINDINGS <br /> 1. This application was reviewed as Zoning File #1438 . <br /> 2. The property is located in the LR-lA Single Family <br /> Lakeshore Residential Zoning District requiring 2 acres in <br /> area. � <br /> 3. The Orono Planning Commission reviewed this application <br /> on August 21, 1989, and recommended approval of the proposed <br /> variances based upon the following findings: <br /> A) The location of the wall wil 1 present no hazards or <br /> sighting problems for users of County Road 15 or <br /> Brackett' s Point Road. <br /> B ) The property is located on a busy curved <br /> intersection of County Road 15 and security has become <br /> a major concern for the applicant. <br /> • Page 1 of 4 <br />
