i <br /> . . {��l <br /> t �l �~ <br /> C'� <br /> Cit� of ORONO <br /> • RESOLUTION OF THE CITY COUNCIL <br /> � NO. 2607 <br /> � <br /> • � • • <br /> A RESOLIITION VACATING PORTIONS <br /> OF A DRAINAGE AND DTILITY EASFIKENT <br /> WITHIN LOTS 3 AND 5, BLOCR 1, <br /> HOLLY ACRES 2ND ADDITION <br /> SBCTION 25, TOWNSHIP 118, RANGE 23 <br /> IN 7.'SL� CITY OF ORONO, <br /> HENNEPIN CODNTY, MINNESOTA <br /> FILE NO. 1384 <br /> WHEREAS, the City of Orono is a municipal corporation organized <br /> and existing under the laws of the State of Minnesota; and <br /> WHEREAS, on February 8, 1989, Fritz, Gullickson filed a petition <br /> with the City of Orono requesting the vacation of a portion of a drainage <br /> and utility easement originally dedicated within the plat of Holly Acres <br /> 2nd Addition, and legally described as follows: <br /> Refer to Exhibit A, attached. <br /> WHEREAS, after due published and posted notice, a public hearing <br /> was held before the Planning Commission on March 20, 1989 regarding said <br /> vacation and all persons interested were given an opportunity to be heard; <br /> and <br /> WHEREAS, after due stand'ing and consideration, the Planning <br /> Commission recommended approval of the requested vacation and the Council <br /> of the City of Orono finds that�said vacation, as proposed, is in keeping <br /> with the public interest in consideration of the following findings: <br /> 1. That portion of the drainage and utility easement serves no public <br /> purpose. <br /> 2. The location of the drainage and utility easement within Lot 5, <br /> Block 1, Holly Acres 2nd Addition subdivision in 1986 realigned the <br /> original boundaries of the property and finc3s that portion of the <br /> above described drainage and utility easement to place severe <br /> restrictions on the building evelope. <br /> NOW, THEREFORE BE IT RESOLVED that the petition of Fritz <br /> Gullickson is hereby granted and that the portion of the dedicated drainage <br /> and utility easement legally described above is hereby vacated. <br /> Page 1 of 2 <br /> • <br />
