l �:., <br /> � C� � l. �'� S ������ S� ����, s r , <br /> X� 1 <br /> SANITARY SEWER CONNECTION <br /> LETTER OF AGREEMENT <br /> This letter of Agreement is between the City of Spring Park (herein refened to as Spring <br /> Park) and the City of Orono (herein referred to as Orono). <br /> Due to a cost hardship, Orono is requesting sanitary sewer service from Spring Park for <br /> one (1) home located at 3800 Dickson EYtension in Orono. The home is presently served by a <br /> septic system. <br /> Orono will collect from the property owner the SAC charges and any permit fees payable <br /> under Orono ordinances for work done in Orono. SAC charges collected by Orono will be paid <br /> to the Metropolitan Council as provided by law. Spring Park will collect from the property <br /> owner charges and permit fees in accordance with a written agreement between the property <br /> owner and Spring Park and applicable Spring Park ordinances. <br /> The property owner will install and maintain the connection and will pay all construction <br /> and maintenance related costs. After installation, the property owner will make payments for <br /> sanitary service charges directly to Spring Park. Orono has no liability for the payment of sewer <br /> use charges for the property. <br /> If the property owner is delinquent in making payments for sanitary sewer services, <br /> Spring Park may certify to Orono the amount of the delinquency and any interest and attorneys <br /> fees payable under the Agreement, and Orono shall then assess the property in the same manner <br /> as it w-ould under applicable Orono ordinances had Orono been the provider of the sanitary sewer <br /> services and the charges been payable directly to Orono and pay to Spring Park any amount it <br /> actually collects. <br /> Orono acknowledges that Spring Park has reserved the right in the agreement with the <br /> property owner to terminate service if the owner is in default under the Agreement. Spring Park <br /> has also reserved the right to terminate service upon one year's written notice after May l, 2005. <br /> Spring Park has no obliaation to Orono to continue to provide sanitary sewer service to the <br /> property owner, and Spring Park's only obligation to the property owner is as set forth in the <br /> Agreement between Spring Park and the property owner. <br /> APPROVED: APPROVED: <br /> � � <br /> � � / <br /> � __ � \\ � � �� <br /> Gabbri Jabbour, Mayor �_�J Jei me .
