City of ORONO <br />RESOLUTION OF THE CITY COUNCIL <br />NO. 2572 <br />A RESOLUTION VACATING AN UNUSED PORTION OF <br />DEDICATED DRAINAGE EASEMENT AT <br />2340 & 2380 ABINGDON WAY WITHIN THE PLAT OF ABINGDON GLEN <br />SECTION 03, TOWNSHIP 117, RANGE 23 <br />IN THE CITY OF ORONO, MINNESOTA <br />FILE NO. 1360 <br />WHEREAS, the City of Orono is a municipal corporation organized <br />and existing under the laws of the State of Minnesota; and <br />WHEREAS, on December 5, 1988, Robert and Margaret Merkow and John <br />and Phyliss Charlton filed a petition with the City of Orono requesting the <br />vacation of a portion of drainage and utility easements originally <br />dedicated within the plat of Abingdon Glen, legally described as follows: <br />The Easterly 5.00 feet of Lot 10, Block 1, Abingdon Glen according to <br />the recorded plat thereof, Hennepin County, Minnesota, lying Northerly <br />• of the Southerly 10.00 feet and Southerly of the Northerly 10.00 feet <br />thereof. Also; <br />The Westerly 5.00 feet of Lot 9, Block 1, Abingdon Glen lying <br />Northerly of the Southerly 10.00 feet and Southerly of the Northerly <br />10.00 feet thereof. <br />WHEREAS, after due published and posted notice a public hearing <br />was held before the Planning Commission on January 17, 1989 regarding said <br />vacation and all persons interested were given an opportunity to be heard; <br />and <br />WHEREAS, after due standing and consideration, the Planning <br />Commission recommended approval of the requested vacation and the Council <br />of the City of Orono finds that said vacation, as proposed, is in keeping <br />with the public interest in consideration of the following findings: <br />1. The vacation does not affect access to or use of any adjoining <br />property. <br />2. The City has not and does not intend to develop, improve or use <br />the portion of dedicated drainage and utility easement described <br />above. <br />3. The portion of dedicated drainage and utility easement as it <br />exists serves no public purpose. <br />• 4. The portion of dedicated drainage and utility easement as a result <br />of a recent lot line rearrangement, no longer coincides with the <br />boundary between the properties at 2340 and 2380 Abingdon Way. <br />Page 1 of 2 <br />
