• <br />City of ORONO <br />RESOLUTION OF THE CITY COUNCIL <br />NO. 2557 <br />A RESOLUTION VACATING AN UNUSED PORTION OF A <br />DEDICATED DRAINAGE EASEMENT AT <br />1410 SHORELINE DRIVE IN THE CITY OF ORONO, MINNESOTA <br />FILE NO. 1351 <br />WHEREAS, the City of Orono is a municipal corporation organized <br />and existing under the laws of the State of Minnesota; and <br />WHEREAS, on October 13, 1988, Jensen Homes, Inc., on behalf of <br />Alfred and Ingrid Harrison, filed a petition with the City of Orono <br />requesting the vacation of a portion of drainage easements originally <br />dedicated within the plat of Lot 1, Block 1, Dragonfly Hill, Hennepin <br />County, Minnesota, and legally described as follows: <br />That part of the most southerly drainage easement on Lot 1, Block 1, <br />Dragonfly Hill, which lies west of a line drawn south perpendicular to <br />the North line of Government Lot 1, Section 11, Township 117, Range <br />23, Hennepin County, Minnesota, from a point on said North line <br />distant 139.00 feet west, as measured along said north line, from the <br />Hennepin County monument at the Meander corner on the South line of <br />Government Lot 4, and the North line of Government Lot 1, in said <br />Section 11; and <br />WHEREAS, after due published and posted notice a public hearing <br />was held before the Planning Commission on November 21, 1988 regarding said <br />vacation and all persons interested were given an opportunity to be heard; <br />and <br />WHEREAS, after due standing and consideration, the Planning <br />Commission recommended approval of the requested vacation and the Council <br />of the City of Orono finds that said vacation as proposed is in keeping <br />with the public interest in consideration of the following findings: <br />1. The vacation does not affect access to or use of any adjoining <br />property. <br />2. The City has not and does not intend to develop, improve, or use <br />the portion of dedicated drainage easement described above. <br />3. The portion of dedicated drainage easement as it exists serves no <br />public purpose. <br />• 4. The portion of dedicated drainage easement no longer is considered <br />as a wetland area due to re -grading approved in 1985 of the pre- <br />existing pond area, which re -grading revised the boundaries of that <br />pond. <br />Page 1 of 2 <br />
