• <br />City of ORONO <br />ESOLUTION OF THE CITY COUNCIL <br />NO. 2555 <br />A RESOLUTION GRANTING <br />VARIANCES TO <br />MUNICIPAL ZONING CODE <br />SECTION 10.03, SUBDIVISION 9 (D), <br />AND SECTION 10.03, SUBDIVISION 15 (F) <br />FILE NO. 1337 <br />WHEREAS, Robert Paige (hereinafter "the applicant") is owner of <br />the property located at 3493 Crystal Place within the City of Orono <br />(hereinafter "City") and legally described as follows: <br />Lots 9 and 10, Block 2, Navarre Heights, Hennepin County, Minnesota <br />(hereinafter "the property"); and ' <br />WHEREAS, the applicant has applied to the City for a variance to <br />Municipal Zoning Code Section 10.03, Subdivision 9 (D) to permit the <br />construction of a detached garage located nearer the front lot. line than <br />the principal building, and a variance to Section 10.03, Subdivision 15 (F) <br />to allow the garage to be constructed 5' from the side lot line where a 10' <br />is side setback is normally required. <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono, <br />Minnesota: ' <br />FINDINGS <br />1. This application was reviewed as Zoning File #1337. <br />2. The property is located in the LR -1C Single Family Lakeshore <br />Residential Zoning District. <br />3. The Orono Planning Commission reviewed this application on <br />November 21, 1988, and recommended approval of the requested variances <br />based upon the following findings: <br />A) The proposed garage will replace an existing garage which is <br />located 3.3' from the side lot line, hence a greater setback than <br />now exists will be obtained. <br />B) The side setback variance is justified based on the location <br />of the existing driveway and applicant's desire to not move that <br />driveway and disrupt additional lawn area. <br />C) Placement of the garage behind the extended west line of the <br />t house in order to avoid a variance would necessitate the removal <br />of a number of mature trees and would eliminate the current rear <br />yard area enjoyed by applicant. <br />Page 1 of 4 <br />
